1. When was the Gujarat State Police Complaints authority constituted?

            Following the instructions passed by the Hon’ble Supreme Court in Prakesh Singh’s case in 2006, Gujarat State Police Complaints authority was constituted under section 32(F) of the Bombay Police (Gujarat Amendment) Act,2007.

2. What is the jurisdiction of the GSPCA?

Gujarat State Police Complaints authority looksinto the complaints against police officers of the rank of Deputy Superintendent of police and abovein respect of serious misconduct, dereliction of duty, and misuse of powers.

3.        What type of complaints fall outside within the jurisdiction of Gujarat State Police Complaints authority?

 a.         The Complaints against the police officers or employees below the rank of Dy. Superintendent of Police fall within the jurisdiction of District police Complaints               authority.

b.        The complaints in which investigation is being done by

(i)        The Vigilance Commission

(ii)       National Human RightsCommission

(iii)      State  Human Rights Commission

(iv)      Commission for Minorities

(v)       Commission for  Scheduled caste and scheduled tribes

(vi)      Commission for women

(vii)Commission  for   Backward  Class  communities

(viii)    Any Other Commission as may be appointed from time to time either by the central Government or by the state Government are not within the jurisdiction of the Gujarat State Police Complaints Authority.

4. How do I make complaints to GSPCA?

Any applicant can register his complaint on the GSPCA’s website www.gspca.gujarat.gov.in. For registering the complaint, the complainant has to fill up the complaint form with required information and proofs if any. GSPCA will look into these registered complaints. The progress and the final disposal of the complaints registered online will be intimated from time to time to the complainant via e-mail.

5.        Can I also sand the complaint by post and to which address?

6. Can I complain to GSPCA if my F.I.R. is not being lodged by the police?

            The matter of not lodging an F.I.R. is within the jurisdiction of the District Police Complaints Authority. Therefore the complainant should send the complaint addressing the Chairman of the concerned District Police Complaints Authority.

7. What do I Have to do if the proper section of law has been not applied?

It is the duty of the investigating officer to apply proper section of law in an offence registered by the police. If the complainant has any grievance regarding the applied section of law, he should complain to the superior officer to the investigating officer. If the complainant is still not satisfied, he should approach the court of law that has the jurisdictionin the matter.

8. WhatI do if the Investigation is not being done properly?

If the complainant feels that the investigation of the offence is not being done properly, he should inform the investigating officer with supporting facts and evidence. If needed, the complainant should inform the superior officer to the investigating officer.  If the complainant is still not satisfied, he should approach the court of law that has the jurisdiction in the matter.
